Default Including Driver ODBC

I have a project where i had to create a temporary database in Access, so the user don't need to have the Access 2003 intalled his computer, but to do so, i have to distribute that with the driver ODBC right?
I would like to know if are there any way to distribute the driver included on the application like in java we can?

1. to create the MS Access database you may via DAO/MS Jet:

This database layer installed by default on most computers

2. you do not need ODBC driver
3. you can't distribute any ODBC driver with your application - prohibited by license and anyway driver must be installed/registered in Windows
